Enterprise or not?

First, you will have to determine whether you have an enterprise. An enterprise is an organisation that provides products or services to others for profit. An enterprise is registered with the Chamber of Commerce (KVK).

When is your enterprise considered an SME?

Your enterprise is an SME if:

• it is an independent business, or partially independent;
• it employs fewer than 250 people (FTEs);
• its annual turnover is € 50 million or less, or its annual balance sheet is € 43 million or less.

When is your enterprise considered an independent business?

Your enterprise is considered a fully independent business if you have no interests in any other enterprise. Or vice versa: if no other organisation has any interests in your business. For the SME declaration, your enterprise may also be partially independent. This is the case if:

• the government has influence on less than 25% of your enterprise;
• your enterprise has less than 50% of the voting rights of another enterprise, or vice versa;
• your enterprise, alone or together with other enterprises, has less than 25% of the capital or voting rights of another enterprise, or vice versa.
