Disputes & advice within patent rights

Patents can give rise to disputes between 2 or more parties. For example, the patent owner might believe that another party has infringed his/her patent or someone might feel wrongfully restricted as a result of someone else's patent.

If a patent owner discovers that someone else is using his/her invention without permission, this is known as infringement. If someone believes that a patent does not fulfil the requirements that are set by the Patent Act, he/she can attempt to have the patent nullified. All legal proceedings relating to patents in the Netherlands take place in the court in The Hague, possibly in interlocutory proceedings. Our office can provide advice in this regard.
