If someone believes that a patent has been wrongfully granted, it is possible to have this patent revoked. This in effect renders the patent invalid.

It is only worthwhile to commence nullification proceedings if the patent restricts an entrepreneur in such a way that this gives rise to financial loss. It may also be worthwhile if you are accused of infringement by a third party.

Non-examination of a patent

In the event that no examination was carried out prior to the patent being granted in the Netherlands, it is possible that an invalid patent may have been granted. This might be because the requirements of novelty or the inventive step were not fulfilled.
